Warranty Policy
Effective August 1, 2020
Each Toypaws product is covered by the warranty described below.
Defect Warranty
Toypaws provides a limited warranty against defects in materials and workmanship, depending on the product type, starting from the date of purchase. For the specific length of the applicable warranty period (the "Warranty Period"), please refer to the product page on the Website.
Please be sure to retain your receipt, as this document is required to exercise your warranty rights.
Warranty Coverage
This Warranty applies only to products manufactured by or for Toypaws and identifiable by the Toypaws trademark or logo affixed thereto. Toypaws warrants each Toypaws product to be free from defects in materials or workmanship ("Defects") for the Warranty Period indicated on the product label, starting from the date the product is received by the purchaser (the "Warranty"). If a product is replaced during the Warranty Period, the replacement product will be covered by the Warranty Period equal to the remaining warranty period of the original product.
Exclusions
This warranty does not apply to any non-Toypaws product, even if packaged or sold with Decathlon products, or to any counterfeit product.
Additional exclusions include:
Defects arising from normal wear and tear;
Defects caused by accident, neglect, abuse, misuse, misapplication, or non-Toypaws products;
Defects caused by exposure to extreme natural conditions, liquids, or gases;
Defects caused by handling by a third party (e.g., postal service, airlines, hotels, etc.);
Defects caused by service (including repairs) performed by anyone other than an authorized Toypaws representative;
Defects caused by product modification without Toypaws's permission;
If the product serial number has been removed or defaced, or if the serial number displayed does not correspond to the nature, type, or origin of the product.
Remedies
Warranty Limitations
This warranty and the remedies set forth herein are exclusive and in lieu of all other warranties, remedies, and conditions, whether written or oral, express or implied. Toypaws expressly disclaims any and all other warranties, express or implied, including, but not limited to, warranties of merchantability, fitness for a particular purpose, title, or non-infringement. Toypaws does not guarantee that it will be able to repair any product covered by this warranty or provide a replacement product that will conform to all the features and functionality of the original product. This warranty gives you specific legal rights, and you may have other legal rights that vary depending on the state in which you live. Because some states do not allow the exclusion or limitation of implied warranties, some of the above exclusions or limitations may not apply to you. In such states, Toypaws' warranty is limited to the maximum extent permitted by applicable state law. This warranty applies only to the original purchaser or gift recipient of the product.
Limitation of Damages
Toypaws is not liable for any direct, indirect, special, incidental, consequential (such as loss of contents, loss of use, loss of time, etc.), or punitive damages, including, but not limited to, personal injury, pain and suffering, emotional distress, loss of revenue, loss of profits, loss of business or anticipated savings, loss of use, or loss of goodwill, whether caused by tort (including negligence), breach of contract, or otherwise, even if foreseeable, resulting from a defect in the product. Some states do not allow the exclusion or limitation of incidental or consequential damages, so the above exclusions may not apply to you.
How to Obtain Warranty Service
If your Toypaws product is defective during the applicable warranty period, please contact our Customer Service department (see the "How to Contact Us" section below for details) to obtain a replacement product. When contacting Customer Service, you will be asked to provide the following information:
Your name;
Your address and phone number;
Your receipt;
Date of purchase;
Photos and/or videos of the defect or damage to the item in question;
A Customer Service representative will provide you with instructions for shipping the product to our service center. Upon receipt, our service center will inspect the product and issue a report indicating whether the product requires repair or replacement and whether the defect is covered under warranty. Important: Please provide a copy of your original receipt to the service center in order to obtain warranty service. Important: Before sending your product for warranty service, it is your responsibility to empty the product and ensure that no items, such as pockets, are left inside. Toypaws is not responsible for any items left inside the product being sent for repair or replacement.
Products Covered by Warranty
Product Replacement
If a product replacement is required, the service center will retain the product and negotiate directly with us to provide you with a new one, but will not return the replacement directly to you. If the product is sold out, Toypaws will replace it with a product of your choice of similar price. In this case, a customer service representative will contact you to complete the purchase of the new product.
If the product cannot be repaired and cannot be exchanged for an identical item, we will provide you with a credit note or refund. Shipping
If a repair or replacement is required, Decathlon will cover any costs of returning the product to you. However, you will be responsible for the costs of shipping the product to any service center, including packaging, shipping, and applicable taxes.
Unauthorized Service Center
If you take your product to an unauthorized service center, any charges for the repair and any defects caused by their work will not be covered under the warranty.
Ownership
After a product or part is replaced, any replacement becomes your property, and the replaced product becomes Toypaws' property. After a refund is issued, the returned product becomes Decathlon's property.
Terms of Sale
This Warranty Policy is incorporated by reference into the Terms of Sale.
